Life/2020 registration and the Medical Science Liaison (MSL) Platform
Fresenius Medical Care Deutschland GmbH (or “FMC”) values your trust and is committed to protecting your personal information. The purpose of this Privacy Notice (the “Notice”) is to give you information about what personal information we collect, use, transfer and disclose, and why when you register for the LIFE 2020 event, attend the event or other educational or training event organized by FMC. In addition, this notice gives you information about the MSL Platform, which is an internal database controlled by FMC which aims to gather in a homogenous form all data related to cooperation with Health Care Professionals (HCPs) and Health Care Organizations (HCOs).
FMC operates in many different countries. Some of these countries have laws related to the collection, use, transfer and disclosure of the personal information of individuals. We take these obligations very seriously, and we are committed to protecting your privacy. The purpose of this Privacy Notice (the “Notice”) is to give you information about what personal information we collect, use, transfer and disclose, and why.

2. What Information About You We Collect, Use, Transfer And Disclose, And Why
Fresenius Medical Care Deutschland GmbH (“FMC”) may have collected and will collect information about you, directly when you register to participate in the LIFE 2020 event or during the invitation process.
FMC may, if you agree, also include some personal information in the MSL Platform. As we are convinced that the medical scientific exchange of information can also decisively improve the quality of treatment for patients, we would like to support this activity internationally. To foster medical-scientific activities in this context, we have implemented an internal database called the MSL Platform that eases the cooperation between you as a potential partner - e.g. scientific speaker - and the FMC administration team. In addition to this, your inclusion in this database will increase your visibility for our colleagues and support them in putting together scientific agendas. As result, more opportunities can emerge to spread your expert knowledge.
In addition FMC is enabled to fulfilling transparency and documentation requirements, legal and compliance demands have been complemented and guided by data protection requirements. The MSL Platform is a database and has been set up by Fresenius Medical Care AG & Co. KGaA (FMC) through its subsidiary Fresenius Medical Care Deutschland GmbH to gather in a homogenous form all data related to cooperation with Health Care Professionals (HCPs) and Health Care Organizations (HCOs). If you give your consent to be listed in our internal database, please tick the checkbox in the registration tool.
This Privacy Notice explains notably how your personal data is collected, used, transferred and disclosed and why.
This Privacy Notice also describes your rights and how you can execute them.
We refer to such identifying information as “Personal Information”. For more specific information regarding what Personal Information about you FMC may collect, use, transfer and disclose, and the purposes for which it may be collected, used, transferred and disclosed, please see the end of this Notice.
FMC collects and processes Personal Information where it is necessary, with your consent if required by applicable law, when we have a contractual relationship, where it is required by law to do so or for purposes connected to legal claims and where it is necessary for the legitimate performance of our business interests and there is no unwarranted impact on your interests or rights.
FMC will not use Personal Information for any other purpose incompatible with the purposes described in this Notice, unless it is required or authorised by law or authorised by you.
3. Transfer and Joint Use of Personal Information
Due to the global nature of FMC's operations, FMC may disclose Personal Information to personnel and departments throughout FMC to fulfil the purposes described at the end of this Notice. This may include transferring Personal Information to other countries (including countries other than where you are based that have a different data protection regime than is found in the country where you are based). If you are located in the European Economic Area (the “EEA”) this may include countries outside of the EEA. Please note that an adequacy decision may not exist for every country data might be transferred to. However, the transfer of your data outside the EEA is based on a strict data transfer agreement including EU standard contractual clauses.
Access to Personal Information within FMC will be limited to those who have a need to know the information for the purposes described at the end of this Notice and may include the Department within FMC that is organising the event that you will attend, Compliance, Legal, Finance and Internal Audit.
From time to time, FMC may need to make Personal Information available to other unaffiliated third parties. For a list of the categories of unaffiliated third parties, please see the end of this Notice. Some of the unaffiliated third parties will be located outside of your home jurisdiction. Third party service providers and professional advisors are expected to protect the confidentiality and security of Personal Information, and only use Personal Information for the provision of services to FMC and its affiliates, and in compliance with applicable law.
FMC will take appropriate measures to protect Personal Information that are consistent with applicable privacy and data security laws and regulations, including requiring service providers to use appropriate measures to protect the confidentiality and security of Personal Information.
5. Data Integrity and Retention
FMC will take reasonable steps to ensure that the Personal Information processed is reliable for its intended use and is accurate and complete for carrying out the purposes described in this Notice.
FMC will retain Personal Information for the period necessary to fulfil the purposes outlined in this Notice or until you revoke your consent (if consent is required) unless a longer retention period is required or permitted by law.
6. Event Participants’ Rights
You also have the right to access your Personal Information, the right to correct inaccurate Personal Information, the right to erase your Personal Information in certain circumstances, the right to object, in whole or in part, to the processing of your Personal Information and the right to receive the Personal Information you have provided to FMC in a structured, commonly used and machine-readable format for onward transmission by you to another employer or other entity without hindrance from FMC. You also have the right to revoke your consent to process your Personal Information (if consent is required by applicable law for all or certain of the processing activities performed by FMC). If you wish to exercise any of these rights, please contact our Data Protection Officer.
Please note, however, that certain Personal Information may be exempt from such access, correction and erasure requests pursuant to applicable data protection laws or other laws and regulations.
You also can file for a complaint with the competent data protection supervisory authority: Hessian Supervisor Authority, Gustav-Stresemann-Ring 1, 65189 Wiesbaden, Germany or to the supervisory authority in the Member State of the European Union where you have habitual residence or place of work or – where applicable – to a court of justice if you consider that the processing of your personal data infringes applicable data protection laws.
Types of Personal Information We May Collect, Use, Transfer And Disclose:
Personal and Contact details: including name, first name, address, email address, telephone number and other contact information, ID details, nationality, gender, birth date, emergency contact information, images or pictures taken within the context of the event or training, dietary restrictions indicated by you;
Professional experience including specialization, function (title, position and employer), license or registration, FMC client number, publications or clinical trials, CV, research fields, assessment by peers and colleagues;
Event and/or training information included notably on the certification form such date and nature of event, participant’s professional interest in the event or training, continuing education credits awarded, specific areas of your interest and FMC products or services about you wish to receive marketing or sales information, including attendance to past events either sponsored or not by FMC, where such information can be obtained from public sources;
Financial information: including invoices and receipts of travel and lodging expenses, bank account information if needed for costs reimbursement or payment of compensation for attending events as speaker, other contractual arrangements already entered into with FMC.
Unless you voluntary disclose sensitive data, FMC will not actively collect information related to your health, ethnic origin, philosophical or religious views, political opinions, union membership, sexual orientation, biometric data or other information considered sensitive by applicable laws.
Your registration to the LIFE 2020 event will be completed once you have consented to the processing of your Personal Information. Please be aware that in case you decide not to consent, your registration to the event or training may not be confirmed.
Concerning the LIFE 2020 Event, the Purposes for Which We May Collect, Use, Transfer And Disclose Personal Information:
Your information will be used for the purposes of managing the organisation of the event which includes:
Event management: Managing the organisation of the medical and continuous education events, notably the invitation of participants, organisation of the events, recording of event related continued education credits, coordinating and facilitating your invitation, registration and attendance, transport, accommodation, meals and other activities within the scope of the event or training;
Expenses management: Managing payments or reimbursements of the cost and compensation associated to your participation on the event or training, including performance of all contractual obligations;
Marketing and sales purposes: Sending you information related to FMC product or services based on your interests, client satisfaction surveys and future invites; create marketing written and video materials for advertising or information purposes;
Compliance: Complying with legal and other requirements, such as record-keeping and reporting obligations, conducting audits, compliance with government inspections and other requests from government or other public authorities, responding to legal process such as subpoenas, pursuing legal rights and remedies, defending litigation and managing your or internal requests, complaints or claims, conducting investigations and complying with contractual obligations or internal policies and procedures.
Concerning the MSL Platform, your personal information will be processed in the MSL platform, with your consent, for FMC to invite you to participate as attendee/speaker to future event
The Categories Of Unaffiliated Third Parties With Whom FMC May Share Personal Information:
Business Partners with whom we organise the event or training (if applicable);
Professional Advisors: Accountants, auditors, lawyers, bankers, and other outside professional advisors in all of the countries in which FMC operates;
Service Providers: Companies that provide products and services to FMC as described above including for the purposes of event or training management;
Public and Governmental Authorities: Entities that regulate or have jurisdiction over FMC such as regulatory authorities, law enforcement, public bodies, and judicial bodies.
